There is a subtle and revealing line between encouraging an employee to accept a settlement offer instead of continuing or initiating disciplinary proceedings and, on the other hand, inappropriate behaviour. Since there may always be an element of inappropriate pressure during settlement negotiations, the employer cannot be sure that the sheltered interview will find the intended route and that the worker would not perceive it as harassment. It is perhaps not surprising that a number of employers do not subtly describe the likely outcome if the employee does not accept the offer of comparison. You can negotiate the terms of your transaction if you think you are able to do so and both parties agree.
